Privacy policy

This Privacy Policy describes our policies and procedures on the collection, use, and disclosure of your information when you use the Service, and tells you about your privacy rights and how the law protects you.

We use your personal data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of this Privacy Policy:

  • Account means a unique account created for you to access our Service or parts of our Service.
  • Affiliate means an entity that controls, is controlled by, or is under common control with a party, where control means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for election of directors or other managing authority.
  • Business, for the purpose of CCPA/CPRA, refers to the Company as the legal entity that collects consumers’ personal information and determines the purposes and means of the processing of consumers’ personal information, that does business in the State of California.
  • CCPA and/or CPRA refers to the California Consumer Privacy Act as amended by the California Privacy Rights Act of 2020.
  • Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to EvanderX, 66 W Flagler Street, Suite 900, PMB 11016, Miami, FL. For the purpose of the GDPR, the Company is the Data Controller.
  • Consumer, for the purpose of the CCPA/CPRA, means a natural person who is a California resident.
  • Cookies are small files placed on your device by a website, containing details of your browsing history on that website among its many uses.
  • Country refers to: Florida, United States.
  • Data Controller, for the purposes of the GDPR, refers to the Company as the legal person which alone or jointly with others determines the purposes and means of the processing of Personal Data.
  • Device means any device that can access the Service such as a computer, a cellphone, or a digital tablet.
  • Do Not Track (DNT) is a concept promoted by US regulatory authorities, in particular the U.S. Federal Trade Commission, for allowing internet users to control the tracking of their online activities across websites.
  • Facebook Fan Page is a public profile named RainesDev created by the Company on Facebook, accessible from facebook.com/rainesdev.
  • GDPR refers to the EU General Data Protection Regulation.
  • Personal Data is any information that relates to an identified or identifiable individual.
  • Service refers to the Website.
  • Service Provider means any natural or legal person who processes the data on behalf of the Company.
  • Third-party Social Media Service refers to any website or social network through which a user can log in or create an account to use the Service.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself.
  • Website refers to RainesDev, accessible from rainesdev.com.
  • You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service.

Collecting and Using Your Personal Data

Types of Data Collected

Personal Data

While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. This may include, but is not limited to: email address; first and last name; phone number; address, state, province, ZIP/postal code, city; and Usage Data.

Usage Data

Usage Data is collected automatically when using the Service. It may include your device’s IP address, browser type and version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers, and other diagnostic data. When you access the Service by or through a mobile device, we may collect certain information automatically, including the type of device, your mobile device unique ID, your mobile operating system, and the type of mobile internet browser you use.

Information from Third-Party Social Media Services

The Company allows you to create an account and log in to use the Service through Third-party Social Media Services such as Google, Facebook, Instagram, Twitter, and LinkedIn. If you register through or grant us access to such a service, we may collect personal data already associated with that account, such as your name, email address, activities, or contact list.

Revisit post-launch: the new site does not currently offer social login. Trim this subsection to match the live Service.

Tracking Technologies and Cookies

We use cookies and similar tracking technologies (beacons, tags, and scripts) to track activity on our Service and store certain information.

  • Cookies or Browser Cookies. A small file placed on your device. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent; however, some parts of our Service may not function without them.
  • Web Beacons. Small electronic files that permit the Company to count users who visited pages or opened an email, and for other related website statistics.

Cookies can be persistent or session cookies. We use both for the following purposes: necessary/essential cookies (session, administered by us) to authenticate users and prevent fraud; notice-acceptance cookies (persistent) to identify whether users have accepted cookies; functionality cookies (persistent) to remember your choices and preferences; tracking and performance cookies (persistent, third-party) to analyze traffic and usage; and targeting and advertising cookies (persistent, third-party) to show advertising more likely to be of interest to you.

Use of Your Personal Data

The Company may use Personal Data to provide and maintain our Service; to manage your account; for the performance of a contract; to contact you by email, telephone, SMS, or other electronic communication regarding updates or service-related communications; to provide you with news, special offers, and general information about similar goods and services unless you have opted out; to manage your requests; for business transfers; and for other purposes such as data analysis, identifying usage trends, and improving our Service.

Revisit post-launch: the SMS contact method and email-marketing references should be confirmed against what the live site actually does. The new site collects no phone numbers by default.

We may share your personal information with Service Providers, in connection with business transfers, with affiliates, with business partners, with other users when you interact in public areas, and with your consent.

Retention of Your Personal Data

The Company will retain your Personal Data only as long as necessary for the purposes set out in this Privacy Policy, to comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies. Usage Data is generally retained for a shorter period, except when used to strengthen security or improve functionality, or when we are legally obligated to retain it longer.

Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company’s operating offices and in any other places where the parties involved in the processing are located. This information may be transferred to and maintained on computers located outside of your jurisdiction, where data protection laws may differ. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer. The Company will take all steps reasonably necessary to ensure your data is treated securely.

Delete Your Personal Data

You have the right to delete or request that we assist in deleting the Personal Data we have collected about you. You may update, amend, or delete your information at any time by signing in to your account, if you have one, or by contacting us. Please note that we may need to retain certain information when we have a legal obligation or lawful basis to do so.

Disclosure of Your Personal Data

Business Transactions

If the Company is involved in a merger, acquisition, or asset sale, your Personal Data may be transferred. We will provide notice before your Personal Data is transferred and becomes subject to a different Privacy Policy.

Law Enforcement

Under certain circumstances, the Company may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities.

Other Legal Requirements

The Company may disclose your Personal Data in the good-faith belief that such action is necessary to comply with a legal obligation, protect and defend the rights or property of the Company, prevent or investigate possible wrongdoing, protect the personal safety of users or the public, or protect against legal liability.

Security of Your Personal Data

The security of your Personal Data is important to us, but no method of transmission over the internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

Detailed Information on the Processing of Your Personal Data

The Service Providers we use may have access to your Personal Data. These third-party vendors collect, store, use, process, and transfer information about your activity on our Service in accordance with their privacy policies.

Analytics

We may use third-party providers such as Google Analytics to monitor and analyze the use of our Service. You can opt out by installing the Google Analytics opt-out browser add-on. For more information, see Google’s Privacy & Terms.

Advertising

We may use Service Providers to show advertisements. These include LinkedIn (privacy policy) and Instagram (privacy policy).

Email Marketing

We may use your Personal Data to contact you with newsletters, marketing, or promotional materials. You may opt out by following the unsubscribe link in any email or by contacting us. We may use providers such as Google Workspace (privacy policy) and Copper CRM (privacy policy).

SMS Consent and Data Sharing Policy

We will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing you with the services of that campaign. We may share your Personal Data, including your SMS opt-in or consent status, with third parties that help us provide our messaging services. All such categories exclude text-messaging originator opt-in data and consent; this information will not be shared with any third parties.

Revisit post-launch: confirm whether RainesDev runs SMS campaigns at all. If not, this section should be removed.

Usage, Performance and Miscellaneous

We may use third-party Service Providers to maintain and improve our Service, including the invisible reCAPTCHA service operated by Google, which may collect information from you and your device for security purposes. See Google’s Privacy Policy.

GDPR Privacy

Legal Basis for Processing Personal Data under GDPR

We may process Personal Data under the following conditions: consent; performance of a contract; legal obligations; vital interests; public interests; and legitimate interests. The Company will gladly help clarify the specific legal basis that applies to the processing.

Your Rights under the GDPR

You have the right to request access to your Personal Data; request correction; object to processing; request erasure; request transfer of your data; and withdraw your consent.

Exercising of Your GDPR Data Protection Rights

You may exercise your rights of access, rectification, cancellation, and opposition by contacting us. We may ask you to verify your identity before responding. You also have the right to complain to a Data Protection Authority. If you are in the European Economic Area, please contact your local data protection authority.

Facebook Fan Page

Data Controller for the Facebook Fan Page

The Company is the Data Controller of your Personal Data collected while using the Service. As operator of the Facebook Fan Page, the Company and Facebook are Joint Controllers. Visit the Facebook Privacy Policy for more information.

Facebook Insights

We use the Facebook Insights function in connection with the operation of the Facebook Fan Page, on the basis of the GDPR, in order to obtain anonymized statistical data about our users. For this purpose, Facebook places a cookie on the device of users visiting the page. For more information, see the Facebook Privacy Policy.

CCPA/CPRA Privacy Notice

This section for California residents supplements the information in our Privacy Policy and applies solely to visitors, users, and others who reside in the State of California.

The following categories are defined in the CCPA/CPRA. Inclusion reflects our good-faith belief that some information from the applicable category may have been collected; it does not mean all examples were collected.

  • Category K: Inferences drawn from other personal information. Collected: No.
  • Category L: Sensitive personal information. Collected: Yes.

Under CCPA/CPRA, personal information does not include publicly available government records, deidentified or aggregated consumer information, or information covered by certain sector-specific laws (HIPAA, CMIA, FCRA, GLBA, FIPA, and the Driver’s Privacy Protection Act).

Sources of Personal Information

We obtain personal information directly from you, indirectly from you, automatically from you (through cookies), and from Service Providers.

Use of Personal Information

We may use or disclose personal information for business or commercial purposes, including operating our Service, providing support, fulfilling the reason you provided the information, responding to law enforcement, internal administrative and auditing purposes, and detecting security incidents.

Disclosure of Personal Information

In the last twelve months we may have disclosed Category A (Identifiers), Category B (California Customer Records categories), and Category F (Internet or other similar network activity) for business or commercial purposes. When we disclose personal information for a business purpose, we enter a contract requiring the recipient to keep it confidential and not use it outside performing the contract.

Share of Personal Information

We may share, and have shared in the last twelve months, your personal information with Service Providers, our affiliates, our business partners, and third-party vendors you or your agents authorize us to disclose to.

Sale of Personal Information

We do not sell personal information as the term is commonly understood. We do allow Service Providers to use your personal information for business purposes such as advertising, marketing, and analytics, and these may be deemed a sale under CCPA/CPRA. The categories that may have been involved are Category A, Category B, and Category F.

Sale of Personal Information of Minors Under 16

We do not knowingly collect personal information from minors under 16 through our Service. We do not sell the personal information of consumers we actually know are under 16 unless we receive affirmative authorization. If you believe a child under 13 (or 16) has provided us with personal information, please contact us.

Your Rights under the CCPA/CPRA

California residents have the right to notice; the right to know and access; the right to opt out of the sale or sharing of personal data; the right to correct personal data; the right to limit use and disclosure of sensitive personal data; the right to delete personal data, subject to exceptions; and the right not to be discriminated against for exercising these rights.

Exercising Your CCPA/CPRA Data Protection Rights

To exercise your rights, California residents can contact us by email at info@rainesdev.com, by visiting our contact page, or by phone at 786-791-8324. Only you, or a person registered with the California Secretary of State whom you authorize, may make a verifiable request. We will disclose and deliver the required information free of charge within 45 days, extendable once by an additional 45 days when reasonably necessary.

Do Not Sell My Personal Information

You have the right to opt out of the sale of your personal information. Once we receive and confirm a verifiable consumer request, we will stop selling your personal information. To opt out of interest-based advertising, you may use the NAI opt-out platform (networkadvertising.org/choices), the EDAA platform (youronlinechoices.com), or the DAA platform (optout.aboutads.info). Any opt out is specific to the browser you use.

Mobile Devices

Your mobile device may give you the ability to opt out of the use of information about the apps you use to serve targeted ads (“Opt out of Ads Personalization” on Android, “Limit Ad Tracking” on iOS). You can also stop the collection of location information by changing your device preferences.

Limit the Use or Disclosure of My Sensitive Personal Information

California residents have the right to limit the use and disclosure of sensitive personal information to that which is necessary to perform the services or provide the goods reasonably expected. We collect, use, and disclose sensitive personal information only in ways necessary to provide the Service.

“Do Not Track” Policy (CalOPPA)

Our Service does not respond to Do Not Track signals. Some third-party websites do track your browsing activities; you can set your browser preferences to inform websites you do not want to be tracked.

California Shine the Light Law

Under California Civil Code Section 1798, California residents with an established business relationship with us can request information once a year about our sharing of their Personal Data with third parties for those third parties’ direct marketing purposes. To request this, contact us using the information below.

California Privacy Rights for Minor Users

California Business and Professions Code Section 22581 allows California residents under 18 who are registered users to request removal of content or information they have publicly posted. To request removal, contact us and include the email address associated with your account. Removal is not guaranteed in all circumstances.

Children’s Privacy

Our Service does not address anyone under the age of 13, and we do not knowingly collect personally identifiable information from anyone under 13. If you are a parent or guardian and aware that your child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from anyone under 13 without verification of parental consent, we take steps to remove that information from our servers.

Our Service may contain links to other websites not operated by us. We strongly advise you to review the privacy policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

Changes to this Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the “Last updated” date. Where appropriate, we will let you know via email or a prominent notice on our Service prior to the change becoming effective. You are advised to review this Privacy Policy periodically.
